SynergenX Health Holdings, LLC, on its own behalf and on behalf of its affiliates and/or wholly owned subsidiaries including but not limited to SynergenX Physician Services, PLLC, Low T Centers, Inc. and Healthco Operations, LLC(collectively referred to as “SynergenX ”, “we”, “us”, or “our”), owns and operates the websites located at http://synergenxhealth.com, and this mobile application (collectively, the “Website” or “Websites”). Through these Websites we offer various online services that enable visitors to the Websites (“you” or “Visitors”) to receive access to various types of health care information and information about our services (“Services”).
SynergenX understands that privacy of information is of great importance to our visitors.
Applicability of this Privacy Policy
This Web and Mobile Privacy Policy (“Privacy Policy”) describes what information SynergenX collects about Visitors on the publicly available portions of the Websites and how that information is used.
Agreement to this Privacy Policy
Your access and use of the Websites are subject to your agreement with the published policies of SynergenX including this Privacy Policy and the Web and Mobile Terms and Conditions together with any amendment and revision to those policies. Collection, Use, and Disclosure of Information
Either SynergenX or a third-party vendor on behalf of SynergenX may automatically collect information while Visitors browse the Websites. We may collect such information by tracking, or asking a third-party vendor to track, your click-stream activity when such information is not ties to a user ID through the use of “cookie” technology or by tracking internet protocol (IP) addresses, as explained below.
Because we want our Websites to better serve Visitors’ needs, we collect some basic information about Visitors and their devices, including, but not limited to:

We use this information to continuously enhance our Website and to better serve our Visitors’ needs. Like many companies, we use “cookies” to help you better navigate the Websites. Your Rights Regarding Your Personal Information
Amendment. You have a right to request that SynergenX amend or delete the Personal Information it collects from your use of the Websites if you believe it is incorrect or incomplete, and you may request an amendment or deletion for as long as the Personal Information is retained by SynergenX. You must submit your request in writing to SynergenX and provide a reason to support the requested amendment. SynergenX may, under certain circumstances, deny your request by sending you a written notice of denial.
Withdrawal of Consent. Subject to applicable law, you may withdraw your consent to uses and disclosures of Personal Information as outlined in this Privacy Policy. You must submit your request in writing to SynergenX. Notice to Patients
At SynergenX, we understand that effective patient communication is key. For that reason, we want to make sure you as the patient can make a fully informed decision about your healthcare. Because of that, SynergenX would advise you that during the course of your treatment with us, you may have laboratory specimens processed by our physician-office laboratory.
The Texas Medical Board requires that SynergenX physician ownership provide certain public information about their financial interests with healthcare facilities. Therefore, this disclosure shall serve as notice to you of financial interests held by SynergenX Physician Services, PLLC.

As a patient you have the right to receive care at the facility or by a provider of your choosing. You are not required to use the facility suggested by SynergenX. To the extent you have any concerns please advise your provider and arrangements will be made to refer you to a comparable facility.
You will not be treated differently by SynergenX staff or providers if you choose to not utilize the services and facilities recommended by SynergenX. Not all alternative facilities are comparable to those of SynergenX. SynergenX staff and providers will make every effort to assist you in identifying a facility most convenient for you that offers the level of service that you need.

Professional Medical Services
SynergenX Health Holdings, LLC is not licensed to practice medicine, does not and will not provide any healthcare service, diagnosis or treatment. The provision of professional medical services will be conducted by licensed practitioners and physicians. It is these practitioners and physicians that may diagnose, treat and prescribe medication for the management of certain conditions. Electing to use this website or engage in the services offered by this website shall not be construed as confirmation that you meet the requirements determined by a licensed medical practitioner to become a patient. Because professional medical services may be provided to you by one or more third-party practitioners or physicians—SynergenX Health Holdings, LLC and its non-professional subsidiaries and affiliates shall not be responsible or liable for any treatment you receive including any injury or adverse outcome. You acknowledge that a licensed practitioner or physician shall be responsible for the medical care you receive including whether you receive any care at all.
Who May Use This Website
Only individuals at least 18 years of age (through a clinician may require a minimum age older than 18 to initiate any form of treatment), that reside in the United States and in a state where SynergenX offers services. You must agree to abide by the terms of the SynergenX Privacy Policy, the Web and Mobile Terms and Conditions, and such revisions, additions and policies of SynergenX in place now or that may be implemented from time to time. In order to access the website and engage in certain functionality authorized by this website, you agree to only utilize compatible electronic devices. This may include downloading and agreeing to the terms of use for one or more mobile applications.
HIPAA and Protected Health Information (“PHI”)
You acknowledge that SynergenX maintains a separate policy concerning HIPAA and Protected Health Information. By your access and use of the Website, you expressly agree that you have read and understand the policies published by SynergenX including its policies concerning the use of your PHI. At times your PHI may be utilized and disclosed without your authorization for essential healthcare operations, that may include without limitation, administrative, financial, legal and quality improvement initiatives. At times SynergenX Health Holdings, LLC and its non-professional subsidiaries and affiliates may be tasked with assisting in certain non-medical aspects of patient care. Consequently, SynergenX Health Holdings, LLC and its non-professional subsidiaries and affiliates as applicable maintain HIPAA compliant Business Associate Agreements (“BAA”). A BAA obligates entities affiliated with a medical practice to maintain PHI as required by HIPAA, even though they may not be providing professional medical services.
However, information that does not constitute PHI may be used by SynergenX as stated in its Privacy Policy, the Web and Mobile Terms and Conditions, and such revisions, additions and policies of SynergenX in place now or that may be implemented from time to time. This may include information that HIPAA would determine is deidentified, rendering the information incapable of being linked to a specific individual.
Revision to Website
SynergenX reserves the right to amend, supplement, suspend, limit or terminate all or any portion of the Website, at any time, without notice. Suspending or terminating all or any portion of the Website may impact any personal information you have shared through the website, including its deletion. Termination or suspension of the Website shall not serve as a waiver, release or limitation of any obligation to which you have agreed that survives such termination or suspension.
Governing Law
You acknowledge that by using and accessing the website, you unequivocally agree to venue and the jurisdiction for any disputes being set in the state and/or federal courts in Houston, Harris County, Texas. Texas governing law shall apply without regard to any conflict of law principles or provisions.
Non-Waiver, Severability, Non-Waiver
SynergenX reserves the right to enforce the policies its publishes on the Website by any means necessary either in law or in equity. Failure of SynergenX to exercise its rights shall not constitute a waiver, release or limitation of any right, remedy, cause of action or defense held by SynergenX, all of which are expressly reserved. To the extent all or any portion of a policy published by SynergenX is deemed to be invalid or unenforceable—such finding shall not affect any other provision of the policy or policies published by SynergenX. You acknowledge and agree that your authorization to utilize the Website granted by SynergenX is an individual right that you hold.
