Our Commitment to Your Privacy

We are committed to protecting the privacy and security of your health information. This Notice of Privacy Practices

(“Notice”) explains how we may use and disclose your protected health information (PHI) and describes your rights

under federal law. Some health information, including records related to substance use disorder treatment, receives

additional protection under federal law (42 CFR Part 2). This Notice explains those protections as well.

Our Legal Duties

We are required by law to:

• Maintain the privacy and security of your PHI

• Provide you with this Notice of our legal duties and privacy practices

• Follow the terms of this Notice currently in effect

• Notify you if a breach of unsecured PHI occurs

• Comply with 42 CFR Part 2 for substance use disorder records

How We May Use and Disclose Your Health Information (HIPAA)

We may use and disclose your PHI without your written authorization for:

Treatment: Providing, coordinating, or managing your health care.

Payment: Billing and payment activities related to your care.

Health Care Operations: Quality assessment, auditing, training, licensing, and administrative activities.

Other Uses Permitted by Law: Including public health, oversight activities, law enforcement, court orders, workers’

compensation, and serious threats to health or safety.

Special Protections for Substance Use Disorder Records (42 CFR Part 2)

Some records related to substance use disorder diagnosis or treatment are protected by 42 CFR Part 2, which provides

greater privacy protections than HIPAA.

Written Consent Is Required

In most cases, your specific written consent is required before we may use or disclose Part 2 records, even for

treatment, payment, or health care operations. Your consent must meet federal requirements and may be revoked at

any time in writing.

Limited Exceptions Without Consent

We may disclose Part 2 records without consent only in limited circumstances, such as:

• Medical emergencies

• Audits and program evaluations

• Certain research activities

• Court orders that meet strict legal standards

• Mandatory child abuse or neglect reporting

Prohibition on Redisclosure

Federal law strictly prohibits redisclosure of substance use disorder records unless expressly permitted by your written

consent or allowed under 42 CFR Part 2. Unauthorized redisclosure is a violation of federal law.

Fundraising

Substance use disorder records are never used for fundraising purposes.

Your Rights Regarding Your Health Information

You have the right to:

• Access your records, including electronic copies

• Direct records to a third party, including apps or patient portals

• Request corrections

• Receive an accounting of disclosures

• Request restrictions (including required out-of-pocket restrictions)

• Request confidential communications

• Receive breach notifications

• Receive a paper copy of this Notice

Fees for electronic access are limited or waived as required by law.

Complaints

You may file a complaint with us or with the U.S. Department of Health and Human Services. You will not be retaliated

against for filing a complaint.
